Step 1: Exercise Your Right to Remain Silent, Immediately
The Fifth Amendment gives you the right to remain silent, and you should use it the moment you are detained. This means do not explain what happened, do not try to “tell your side,” and do not answer questions beyond providing your name when legally required. Anything you say, even something you believe is helpful, can and will be used against you by the Bexar County DA’s Office.
Texas law does not require police to stop questioning you unless you clearly and unambiguously invoke your right to remain silent and your right to an attorney. The clearest way to do this: “I am invoking my right to remain silent and my right to an attorney. I will not answer questions without my lawyer present.” Then stop talking.
Step 2: Do Not Consent to Searches
If officers ask for permission to search your vehicle, your phone, your home, or your belongings, you have the right to decline. A polite but firm “I do not consent to a search” preserves your legal options. If they search anyway, your attorney can challenge the search in court. If you consent, that challenge is far more difficult.
Step 3: Contact The Hull Firm as Soon as Possible
The Hull Firm operates 24 hours a day, 7 days a week for exactly this reason. The moment you are allowed access to a phone, call 210-692-4913. Our San Antonio criminal defense attorneys begin working your case the day you call, not after paperwork is filed, not after arraignment.
Early attorney involvement allows us to:
- Preserve video footage, text messages, and witness accounts before they are lost
- Challenge constitutional violations in the arrest or search before they’re buried in the record
- Engage the Bexar County DA’s Office before charges are formally filed
- Secure bond conditions that allow you to maintain your job and family contact
- Prevent you from making statements or social media posts prosecutors will exploit
Step 4: Stay Off Social Media
Do not post about your arrest. Do not post photos. Do not contact witnesses or the alleged victim online. Prosecutors in Bexar County actively monitor social media during the pendency of criminal cases. A single post, even one that seems harmless or sympathetic, can be used as evidence, as a basis for additional charges, or as a violation of bond conditions.
What Happens Next: The Bexar County Court Process
After booking at the Bexar County Adult Detention Center, you will appear before a magistrate for an initial bond hearing, typically within 48 hours. The Hull Firm can appear at this hearing and advocate for the lowest possible bond with the fewest restrictive conditions. Your case then proceeds through either Bexar County Courts at Law (misdemeanors) or Bexar County District Courts (felonies) at the Cadena-Reeves Justice Center. Understanding this system, the prosecutors assigned to each court, the judges’ tendencies, and how the DA values different case types is a meaningful advantage that only comes from consistent local practice.
Why Former Prosecutors Make the Difference
The attorneys at The Hull Firm, including former prosecutors Mark Hull and Allison Tisdale, have over 20 years of combined criminal defense experience and more than Over 930 dismissals or rejected cases since 2021 across Texas.
Having sat on the prosecution side, they understand exactly how the Bexar County DA’s Office evaluates cases, what arguments resonate with local courts, and where the state’s evidence is weakest.
