#1 Goal Is Dismissal

Despite evolving marijuana laws across many other states, Texas maintains some of the strictest regulations regarding cannabis. In Austin and throughout the state, recreational marijuana remains illegal, and even minor possession can lead to significant criminal charges and lasting consequences. Understanding Texas’s specific marijuana laws is crucial for residents and visitors alike. For detailed information on specific charges, please visit our Marijuana Possession page.

Understanding “Marihuana” Under Texas Law

In Texas, “marihuana” (as spelled in the Texas Health and Safety Code) refers to the plant Cannabis sativa L., whether growing or not, and includes all parts of the plant, its seeds, resins, and derivatives. Importantly, this does not include the mature stalks, fiber produced from the stalks, oil or cake made from the seeds, or sterilized seeds incapable of germination.

However, concentrated forms of THC (tetrahydrocannabinol), such as edibles, vape oils, or wax, are not classified as “marihuana.” Instead, they fall under the broader “Controlled Substances” Act, often categorized under Penalty Group 2, making their possession even more severely penalized than raw marijuana flower. Even small amounts of concentrates can lead to felony charges.

Penalties for Marijuana Possession in Texas

Texas law categorizes marijuana possession offenses primarily by weight, with penalties escalating significantly as the amount increases:

  • 2 Ounces or Less: Class B Misdemeanor
    • Up to 180 days in county jail
    • Fine up to $2,000
  • More than 2 Ounces, Less than 4 Ounces: Class A Misdemeanor
    • Up to 1 year in county jail
    • Fine up to $4,000
  • More than 4 Ounces, Less than 5 Pounds: State Jail Felony
    • 180 days to 2 years in state jail
    • Fine up to $10,000
  • More than 5 Pounds, Less than 50 Pounds: Third-Degree Felony
    • 2 to 10 years in state prison
    • Fine up to $10,000
  • More than 50 Pounds, Less than 2,000 Pounds: Second-Degree Felony
    • 2 to 20 years in state prison
    • Fine up to $10,000
  • More than 2,000 Pounds: First-Degree Felony
    • 5 to 99 years or life in state prison
    • Fine up to $50,000

These penalties can be enhanced if the offense occurs in a drug-free zone (e.g., near a school) or if there are prior convictions.

Marijuana Possession & Consequences

Beyond Possession: Other Marijuana Offenses

  • Delivery of Marijuana: Selling or distributing marijuana carries much harsher penalties than simple possession, often starting as a State Jail Felony even for small amounts.
  • Marijuana Cultivation: Growing any amount of marijuana is a felony offense in Texas, with penalties tied to the number of plants.
  • Drug Paraphernalia: Possession of items like pipes, grinders, or rolling papers is a Class C misdemeanor, punishable by a fine of up to $500.

Collateral Consequences of a Marijuana Conviction

Beyond fines and jail time, a marijuana conviction in Texas can lead to significant collateral consequences, including:

  • A permanent criminal record, affecting future employment, housing, and educational opportunities.
  • Suspension of your driver’s license, regardless of whether the offense involved driving.
  • Ineligibility for certain professional licenses.
  • Difficulty obtaining student loans or grants.

Facing a Marijuana Charge in Austin? You Have Options.

While Texas’s marijuana laws are strict, a charge does not automatically equate to a conviction. There are numerous defense strategies an experienced criminal defense attorney can employ, such as:

  • Challenging the legality of the police stop or search.
  • Disputing the amount of marijuana found.
  • Questioning the chain of custody or lab analysis of the substance.
  • Arguing lack of knowledge or possession.

If you are facing marijuana charges in Austin, it is crucial to consult with a knowledgeable Austin criminal defense attorney immediately. They can evaluate the specifics of your case, protect your rights, and work towards the best possible outcome, whether that involves challenging the charges, negotiating with prosecutors, or representing you in court.
