Unlike family violence cases, these don't carry the same no-drop policy — the complaining witness's cooperation matters more. Evidence quality, the complaining witness's credibility, and the circumstances of the incident all affect how aggressively the DA pursues the case.

A Class B misdemeanor carries up to 180 days in jail and up to a $2,000 fine — this is the level of a first-offense DWI and simple assault. A Class A misdemeanor carries up to one year in jail and up to a $4,000 fine — this is the level of DWI with a child passenger, assault causing bodily injury, or second-offense DWI. Both are permanent on your record without expungement.

A Class C public intoxication conviction can be expunged once the case is fully resolved if it meets Texas Chapter 55 eligibility requirements.
