What Texas DUI Actually Is

In Texas, DUI under TABC §106.041 applies only to drivers under 21. Any detectable amount of alcohol while operating a motor vehicle in a public place is a Class C misdemeanor — no BAC threshold, no impairment required. A DUI conviction carries a fine, 60-day license suspension, alcohol education program, and community service. It is permanent. It appears on background checks immediately and stays there until expunged after a dismissal. For students at UT Austin, ACC, St. Edward’s, and other Austin institutions, the non-criminal consequences of a DUI conviction can be more immediately damaging than the criminal sentence.

Is a DUI Lawyer Worth It? Yes — For Several Specific Reasons

FAFSA financial aid. A DUI conviction may affect federal student aid eligibility under the Higher Education Act, particularly for drug-related convictions. Alcohol-only DUI convictions have a more nuanced analysis, but UT Austin and other institutions conduct background checks for campus housing and professional programs where the conviction will appear.

Professional licensing. Future careers in nursing, teaching, law enforcement, social work, and law all involve licensing boards that conduct background checks. A DUI conviction at 19 appears on those background checks when you apply for a license at 25.

Military service. Military enlistment requires disclosure of criminal convictions. A DUI conviction can affect enlistment eligibility and certain military occupational specialties.

The DUI can escalate to DWI. A driver under 21 with a BAC of 0.08 or above, or showing signs of impairment, faces a full adult DWI charge under Penal Code §49.04 — not just a Class C DUI. The APD officer’s documentation of the investigation determines which charge is filed. An attorney who is retained immediately after the arrest can sometimes influence how the case is charged before the County Attorney’s office files.
