The First Proceedings: Magistration
After arrest and booking at the Travis County Jail, magistration occurs within 24 to 48 hours. At magistration, a Travis County magistrate reviews the charges, sets bond conditions, and issues any Emergency Protective Order required by the circumstances (for family violence arrests). This is not a full court hearing — it is the bond-setting proceeding. The first formal court date in the Travis County Courts at Law or District Courts typically follows within 2 to 6 weeks of arrest.
The ALR Deadline Runs Simultaneously
For DWI cases, the 15-day ALR deadline is running from the day of arrest — before any court date is scheduled. We file the ALR hearing request the day you retain us. The ALR proceeding at SOAH is separate from the Travis County court schedule and runs on its own timeline.
After the First Court Date
The first scheduled court date is typically for docket management — confirming representation, setting discovery deadlines, and scheduling future hearings. Most Travis County DWI and criminal cases require multiple court settings before reaching resolution. Cases with suppression motions require a separate hearing before the court rules on admissibility. Cases that proceed to trial require additional settings for pretrial preparation and jury selection.
What Affects the Timeline
Several factors can extend the timeline: waiting for bodycam and dashcam footage (production can take 30 to 60 days after the open records request), waiting for blood test results from the Travis County ME’s lab (typically 60 to 90 days), suppression hearing scheduling, and trial scheduling based on court availability.
