Alcohol and Drug-Related DWI Defense

Texas DWI charges are not limited to alcohol. A person may be accused of DWI based on marijuana, prescription medication, an illegal drug, over-the-counter medication, or a combination of substances.

Unlike alcohol, most drugs do not have an equivalent numerical impairment threshold comparable to a BAC of 0.08. A positive toxicology result may show that a substance was present, but it does not automatically establish when it was consumed or whether it caused impairment while driving.

A lawful prescription also does not automatically prevent a DWI charge. The evidence must still be examined to determine whether the prosecution can connect the medication to an alleged loss of normal faculties.
