Your driver’s license

Your DWI Case Isn’t the Only Clock Running

An Austin DWI arrest can trigger a separate Administrative License Revocation process through the Texas Department of Public Safety.

If an officer served you with a DIC-25 suspension notice, Texas generally gives you 15 days from the date you receive the notice to request an ALR hearing.

The ALR hearing is separate from the criminal DWI case. Failing to request the hearing within the applicable deadline may waive your opportunity to contest the administrative suspension.

When The Hull Firm’s representation includes the ALR proceeding, the firm acts promptly to request the hearing and protect the client’s opportunity to challenge the suspension.

What happens next

One Arrest. Two Separate Proceedings.

1 The Criminal DWI Case

The criminal case determines whether the State can prove the DWI charge against you. The defense may examine:

  • Reason for the traffic stop
  • Body-camera and dash-camera video
  • Officer observations
  • Standardized field sobriety tests
  • Breath testing
  • Blood-draw procedures
  • Laboratory testing
  • Toxicology
  • Drug Recognition Expert evidence
  • Whether constitutional or procedural violations occurred

2 The ALR License Case

The Administrative License Revocation proceeding concerns your driver’s license. Depending upon the circumstances, the defense may:

  • Request the hearing before the applicable deadline
  • Review the DPS suspension paperwork
  • Examine the basis for the stop and arrest
  • Review breath or blood-testing evidence
  • Challenge whether DPS can establish the required issues
  • Seek testimony or evidence relevant to the suspension
  • Evaluate license options if a suspension occurs

These proceedings are separate. A result in one does not automatically determine the result in the other.

Why early action matters

A DWI Arrest Can Affect More Than the Criminal Charge

Depending on the charge and circumstances, a Texas DWI case can expose a person to criminal penalties, driver’s license consequences, court requirements, increased insurance costs, employment complications and a lasting criminal record.

Early review gives the defense team time to preserve evidence, understand what happened during the stop and arrest, address the ALR deadline and begin evaluating the State’s evidence.

Driver’s License

An ALR suspension can proceed separately from the criminal case.

Criminal Record

A DWI conviction can create long-term consequences.

Jail and Fines

Potential penalties depend on the level of the charge and case circumstances.

Employment

Some jobs, professional licenses and driving positions may be affected.

Insurance

A DWI-related suspension or conviction can affect insurance costs.

Future Charges

Prior DWI convictions can affect how future allegations are charged.

Why The Hull Firm

Travis County Court Experience

Building the defense

We Don’t Start With the Police Report. We Start With What Actually Happened.

A police report tells the officer’s version of the arrest. A DWI defense requires looking beyond that report and examining the evidence independently.

01

The Traffic Stop

Was there a lawful reason for stopping the vehicle?

02

Body-Camera and Dash-Camera Video

Does the video support what was written in the police report?

03

Field Sobriety Testing

Were the standardized tests administered and interpreted properly?

04

Breath Testing

What device was used, how was it maintained and were proper procedures followed?

05

Blood Testing

The defense can examine the blood draw, chain of custody, laboratory procedures and testing evidence.

06

Drug DWI Evidence

Cases involving marijuana, prescription medications or controlled substances may require review of toxicology and Drug Recognition Expert evidence.

Let Us Review the Evidence

I hired this firm two years ago for my husband. The case was a very bad one with what he was accused of. They made this whole ordeal easy, kept me in the loop, told me exactly what to expect and what they truly thought about everything. I'm so glad to say after 2 years (no court) because the evidence was not there and I let them know from the start it was all a lie and a case of jealousy and people being in their feelings because I told the truth. They seem that and presented everything I had evidence of to the DA and as on May 15th 2025 CASE DISMISSED AND DROPPED!!! This could not have come at a greater time being we are expecting our baby girl in a week. Mrs. Allison is such an amazing and sweet lady! She has been such a great support, the WHOLE TEAM! I see exactly why they received multiple awards for best law firm in the state! Thankyou thankyou HULL FIRM!

Austin DWI and ALR Questions

How long do I have to request an ALR hearing after a DWI arrest in Austin?

If you were served with a DIC-25 suspension notice, Texas generally allows 15 days from the date notice is received to request an Administrative License Revocation hearing.

Different timing can apply when a suspension notice is later mailed following blood-test results, so the deadline should always be confirmed from the actual DPS notice.

Is the ALR hearing the same as my DWI criminal case?

No. The ALR proceeding is an administrative driver’s license matter handled through Texas DPS and the State Office of Administrative Hearings.

The criminal DWI case proceeds separately through the criminal courts.

Will requesting an ALR hearing automatically save my license?

No result can be guaranteed. Requesting the hearing preserves the opportunity to contest the administrative suspension before an Administrative Law Judge.

What happens if I miss the ALR hearing deadline?

Missing the applicable hearing-request deadline can waive your opportunity to challenge the administrative suspension through the normal ALR hearing process.

Because deadlines depend upon the type of notice involved, speak with an attorney promptly.

What should I bring to my consultation?

Bring or photograph any paperwork you received after the arrest, particularly:

  • DIC-24
  • DIC-25
  • Bond paperwork
  • Court paperwork
  • Property receipt
  • Breath or blood-test documents
  • Driver’s license paperwork

Do not worry if you do not have everything.

Can I fight a DWI if I failed a breath or blood test?

A test result is evidence, but the surrounding circumstances and testing process still matter.

A defense attorney may examine testing procedures, device or laboratory records, blood collection, chain of custody, underlying data and other relevant evidence.

What if I refused a breath or blood test?

A refusal can create separate driver’s license consequences and may also become evidence in the criminal case.

The specific consequences depend upon the circumstances and driving history.

Can marijuana or prescription medication lead to a DWI charge in Austin?

Yes. Texas DWI allegations can involve alcohol, marijuana, prescription medication, controlled substances or combinations of substances.

Drug-related cases often rely heavily on officer observations, toxicology and, in some cases, Drug Recognition Expert evidence.

What if this is my first DWI?

A first DWI can still carry serious criminal and driver’s license consequences.

The actual charge level, available defenses and possible outcomes depend on factors including BAC allegations, accident circumstances and the evidence.

How much does an Austin DWI attorney cost?

Fees depend upon the charge, complexity of the case and representation required.

The Hull Firm offers a free initial consultation so the firm can review the circumstances before discussing representation.
