Texas Zero Tolerance Laws for Underage Drivers
Under Texas Alcoholic Beverage Code § 106.041, minors can be charged with driving under the influence (DUI) if they operate a motor vehicle in a public place while having any detectable amount of alcohol in their system—even if they are below the adult intoxication threshold of 0.08% BAC. For higher BACs or aggravating factors, they may be charged with a full DWI offense, which carries more severe penalties.
